**Former California Teacher and Cheerleading Coach Charged for Allegedly Sending Lewd Video to Underage Girls**

Nicholas Moseby, a 43-year-old former teacher and cheerleading coach at Diablo Vista Middle School in Danville, California, is currently on trial after being arrested in September 2022. He faces allegations of sending a naked video to two underage girls, aged 14 and 15.
Moseby’s defense attorney, Manisha Daryani, argued in a Contra Costa County courtroom that the explicit text was sent by mistake and intended for a sex worker. “He communicates with many sex workers,” Daryani stated, as reported by the East Bay Times. “We all have phones and sometimes accidentally text the wrong person. It happens.”
Since his arrest, additional alleged victims have come forward, leading to further accusations against Moseby. Initially, he was charged with three felonies: two counts of committing a lewd act upon a child and one count of distributing or showing pornography to a minor, according to the Contra Costa County District Attorney’s Office.
The former educator is also accused of groping, grinding against, and making lewd comments to other alleged victims who have since come forward, resulting in an additional charge of sexual battery. Before his time at Diablo Vista Middle School, Moseby taught biology at San Ramon Valley High School and served as a cheer instructor at Nor Cal Elites in nearby San Ramon.
Moseby was held in custody until he posted a $200,000 bail in December 2022. The trial, originally set for November 2023, has faced multiple delays, having been postponed eight times due to various requests for additional time from both his defense team and prosecutors.
